1. Who we are

Eterna is an online store operated by Cabrera Feijoo Consulting, tax ID CHE-271.164.828, registered office Avenue Alexandre-Vinet 3, 1815 Clarens, Switzerland.

This document governs your access to our store and the purchase of personalised pet portraits.

2. How the service works

  1. You upload a photo of your pet to our site.
  2. You choose an artistic style from those available.
  3. You pay the order. At that moment, artificial intelligence generates a unique portrait from your photo.
  4. We email you a preview so you can approve or request a redo.
  5. Once approved, we print it on canvas through our print partner (Gelato) and ship it to you.

3. Price and payment

Each product's price is shown on the site before checkout, VAT included unless otherwise stated. Applicable VAT is the one in force in your delivery country (OCSS regime).

We accept Visa, Mastercard, American Express, and payment methods configured in Shopify. Payment is collected at order time.

4. Rights over the photo you upload

By uploading a photo you declare that:

  • You own the rights to that photo, or have explicit permission from the rights holder.
  • The pet in the photo is yours or you act with its owner's consent.
  • The photo does not contain other identifiable persons without their consent.

If you upload a photo without meeting the above, you're responsible for any claims. We have no technical means to verify this; we rely on your declaration.

5. Rights over the generated portrait

The AI-generated portrait based on your photo is licensed to you under the following terms:

  • Personal use: you may use the portrait in your home, personal social media and private gifts without restriction.
  • Commercial use: if you want to use it commercially (sell prints, include in business advertising, etc.) you need our prior written authorisation.
  • We retain the right to display the portrait in our own communications (site gallery, Eterna social media) unless you expressly tell us not to — in which case we respect it immediately.

6. Use of artificial intelligence

We use commercial AI models (currently Flux Kontext by Black Forest Labs, via fal.ai) to generate portraits. The AI:

  • Is not trained on your photos. We use infrastructure-as-a-service; your photos are not used to improve the model.
  • May produce small artistic inaccuracies. We do not guarantee an exact photographic reproduction — we promote a recognisable artistic interpretation.
  • If the result is not recognisable as your pet, we redo it free (see returns policy).

7. Shipping

  • We ship throughout the European Union. See shipping policy for times and countries.
  • Shipping is from European production centres of our provider Gelato.
  • Estimated delivery times are 3-7 business days from payment; includes 48-72 hours production + 1-3 days transport. Many customers receive in 48-72h.

8. Withdrawal and returns

Being a personalised product made according to your specifications (photo + style chosen by you), the 14-day consumer withdrawal right foreseen in art. 16.c of the EU Consumer Rights Directive (and equivalents in member states) does not apply.

Nevertheless:

  • If the portrait doesn't reasonably look like your pet, we redo it free of charge at our cost — no questions asked.
  • If the canvas arrives damaged, broken or with print defects, we replace it free by sending us a photo of the damage within 48 hours of delivery.

9. Intellectual property

The Eterna brand, the website and its contents (texts, logos, code, mockups, non-AI-generated photographs) are property of Cabrera Feijoo Consulting or its licensors. Reproduction without authorisation is not permitted.

Generated portraits are licensed per clause 5 of this document.

10. Liability limitation

We make reasonable efforts for the service to work well. However, we're not liable for:

  • Printing or transport delays caused by our provider Gelato or carriers.
  • Temporary service interruptions for maintenance or technical causes.
  • Indirect losses, lost profits or moral damages arising from service use.

Total liability for an order is limited to the amount paid for that order.

11. Modifications

We may modify these terms at any time. The current version is published at https://eterna.dog/terms with last update date. Changes do not retroactively affect orders already placed.

12. Jurisdiction and applicable law

These terms are governed by the law of Montreux, Canton of Vaud, Switzerland. Any dispute will be submitted to the courts of Montreux, Canton of Vaud, Switzerland, without prejudice to the rights assisting consumers at their habitual residence.
